By accessing or using CatalogRecall API ("Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.
2. Description of Service
CatalogRecall API provides a developer API for matching products, catalog rows, and listings against official U.S. recall data sources including CPSC and openFDA Food/Device. The Service returns possible recall matches with confidence scores, source links, and review guidance.
3. Disclaimer of Authority
CatalogRecall API is not a substitute for official government recall notices or professional legal advice. The Service:
- Does not constitute legal advice or official safety certification
- May miss recalls or return false positives
- Should not be the sole basis for product decisions
- Is an automated matching layer, not a replacement for manual verification
You are solely responsible for verifying recall matches against official sources and complying with applicable safety laws.
4. Eligibility
You must be at least 18 years old and have the authority to enter this agreement. If you are a business, you represent and warrant that you are duly authorized to enter this agreement on behalf of your organization.
5. API Key Management
Responsibility: You are responsible for maintaining the confidentiality of your API key. Do not share your API key with untrusted parties or commit it to public repositories.
Single Display: Raw API keys are displayed once on the checkout success page. Store them securely in your server-side secrets manager immediately. We cannot retrieve lost keys, but you can generate a replacement by contacting support.
Revocation: You may revoke API keys at any time through your account dashboard. Revoked keys are immediately invalid.
6. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose
- Attempt to reverse-engineer or extract recall data for redistribution
- Abuse rate limits or attempt to overwhelm the Service
- Share your API key with competitors or unauthorized parties
- Resell access to the Service without permission
- Scrape or bulk-export raw recall records
- Misrepresent recall matches as official government statements
7. Rate Limits and Usage
Rate limits are enforced per API key and globally to maintain service reliability. If you exceed your plan's monthly call limit or request limits, additional calls may be rate-limited or billed at overage rates (if applicable to your plan).
8. Billing and Payments
Recurring charges: By selecting a paid plan, you authorize us to charge your payment method monthly on the anniversary of your purchase.
Payment processor: All payments are processed through Stripe and subject to Stripe's terms and policies.
Cancellation: You may cancel your subscription at any time through your account dashboard. Cancellation takes effect at the end of your current billing period. No refunds are issued for unused portions of the month.
Disputes: Contact [email protected] within 30 days of a charge to dispute billing errors.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
- The Service is provided "as is" without warranties of any kind
- We are not liable for indirect, incidental, consequential, or punitive damages
- Our total liability for any claim is limited to the amount you paid for the Service in the 12 months preceding the claim
- We are not responsible for your use of API data or failures to verify recall information
- We are not responsible for product safety decisions made based on the Service
10. Indemnification
You agree to indemnify and hold harmless CatalogRecall API from any claims, damages, or costs (including legal fees) arising from:
- Your use of the Service
- Your violation of these Terms
- Your misrepresentation of recall matches as official government notices
- Your failure to verify recall information or comply with applicable laws
- Product decisions made based on the Service
11. Data and Recall Information
Ownership: Recall data is sourced from public U.S. government agencies (CPSC, FDA). We do not own this data. You may access it through our Service only as authorized by these Terms.
Data freshness: Recall data is updated on a best-effort basis but may not reflect the very latest government records. Always verify against official sources.
No redistribution: You may not extract, scrape, or redistribute recall data from the Service without attribution and in compliance with original government source terms.
12. Service Uptime and Support
While we strive for high availability, we do not guarantee 100% uptime. The Service is provided as-is with no uptime SLA for Free plan customers. Paid customers may request support at [email protected].
Emergency support and guaranteed response times are available for Enterprise customers only.
13. Termination
We may terminate your access to the Service if you:
- Violate these Terms
- Engage in abuse or harmful conduct
- Fail to pay outstanding bills (after 30 days notice)
- Use the Service for unlawful purposes
Upon termination, your API keys are immediately revoked, and all access ceases.
14. Changes to Terms and Pricing
We may update these Terms or pricing at any time. We will notify you of material changes by email. Continued use of the Service after changes constitutes acceptance.
15. Governing Law
These Terms are governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles. Any legal action must be brought in the courts of the United States.
